What should a car sale contract include?

Everything you might want to prove later: who buys and sells, exactly which car it is, the price and how it is paid, when the car changes hands, what is known about defects and who pays fines. This generator puts those parts in a fixed order.

Part Why
Parties and ID You know for sure who you are dealing with
Plate and VIN The contract demonstrably covers this car
Mileage and tellerstandoordeel (odometer verdict) Prevents disputes about the odometer
Price in figures and words No misunderstanding about the amount
Date and time of handover From then on the car is at the buyer's risk
Known defects and damage Honesty prevents a dispute afterwards
Transfer and fines Fines after the handover are for the buyer

A verbal agreement is binding too, but on paper you can prove what you agreed. Read the step-by-step guide in write a car sale contract.

Can I include "sold as viewed and test-driven"?

Yes, in a sale between private persons. The clause is usually valid but will not protect you if you conceal a known defect. When a dealer sells to a consumer it does not work: statutory conformiteit (conformity) always applies, and a defect within 1 year of delivery is presumed to have existed already. The generator therefore leaves the clause out when the seller is a dealer.

How do you arrange payment safely?

Agree that the car only leaves once the money has actually arrived in the seller's account. A screenshot or proof of payment proves nothing. Cash is allowed between private persons but risky. Since 1 January 2026 a dealer may not accept €3,000 or more in cash, even in instalments: read more about the cash limit. Unsure about the buyer? Run the scam check.

When does the car officially belong to the buyer?

After the registration transfer. It costs €13.10 in 2026, online or at a registration counter, and the buyer must already have at least third-party (WA) insurance. The seller only releases the car after receiving the vrijwaringsbewijs (indemnity certificate). Follow the handover checklist and the guide to transferring car ownership.

How do you print or save the contract?

Choose "Print or PDF" and print two copies, or save it as a PDF from your browser's print dialog. "Download as HTML" saves a file you can open later in any browser. Sign both copies; each party keeps one. Empty fields become a dotted line so you can also fill them in by hand.

Frequently asked questions

Is a verbal car sale agreement valid?

Yes. A verbal agreement to buy a car is binding, even without a signature. Without paperwork, though, it is hard to prove what you agreed on price, defects or the time of handover. So put it in writing, in two copies signed by both buyer and seller.

Who pays traffic fines after the sale?

The buyer, for everything from the moment the car is registered in their name. Traffic fines go to the registered keeper in the RDW register. So only hand over the car after the transfer and record the date and time in the contract. With that contract and the indemnity certificate you can prove when ownership changed.

Can the buyer pay in cash?

Yes, between private persons it is allowed. Since 1 January 2026 a dealer may not accept or pay cash for amounts of €3,000 or more, even when split into instalments. Between private persons cash is still risky because of counterfeit notes and robbery. A bank transfer that has arrived before you hand over the keys is safer.

Is this contract legal advice?

No. It is a template with the clauses that are common in a car sale. Check every detail and adapt it to your own situation. For special situations, such as a car under finance, an export or a dispute, ask a lawyer for help.
