Sale contract (koopovereenkomst)

Updated All terms from A to Z

A koopovereenkomst (sale contract) records what buyer and seller agreed. A verbal sale is also valid, but putting it on paper prevents arguments afterwards. Include at least:

  • names, addresses and signatures of buyer and seller;
  • licence plate (kenteken), make, model and mileage;
  • price, payment method, and date and time of handover;
  • known defects and damage;
  • whether there is a warranty, and if so which one;
  • that the registration will be transferred right away.

Why it matters when buying or selling

Between private persons, the contract is often your most important evidence. If the seller lists known defects, the buyer usually cannot rely on them later. Write down the exact time of handover, so it is clear who is responsible for fines and damage after that moment.

If you buy from a dealer, the contract cannot limit your statutory rights in a consumer sale. Agree on payment too: since 1 January 2026, a trader may not accept €3,000 or more in cash.
